GENERAL CONDITIONS FOR THE PROVISION OF SERVICES
Friendly Terms for Provision of Services
Here are the details on how our services work in general. In addition to these general conditions, there may be additional ones specially created for you, but if so, they must be attached to these and signed by both parties.
We want you to understand everything in a clear and friendly way:
1. Budgets
1.1 The amounts mentioned in the quotes do not include VAT and remain valid for 30 days. If we find errors in the calculations during this period, we will correct them.
1.2 The values of the services we have already performed cannot be used as a reference for future orders.
1.3 If you make any changes to the specifications after confirming the quote, we will charge extra.
1.4 To confirm an order, we need you to return the completed and signed quote, or simply inform us by email that you accept, mentioning the quote number and quantity.
1.5 If you accept a quote and then cancel it, we will charge you for all expenses incurred up to that point.
1.6 Even if you choose not to go ahead with the quoted service, we will charge you for expenses incurred to date, such as mockups or proofs.
2. Models and Intellectual Property
2.1 Mockups are free for the first review. After that, we ask you to send it back to us with your corrections or validation. Any errors not identified during this review are your responsibility, and we cannot offer discounts.
2.2 The prepress service is normally free of charge for up to 1 hour, and the resulting materials are our property unless we agree otherwise in writing.
2.3 If you provide us with artwork, it must be in PDF format, following our guidelines.
2.4 Elements that we have to acquire from third parties, such as images in image banks, are protected by the terms established by their suppliers.
2.5 You always have the reproduction rights of the originals you entrust to us. We assume no responsibility towards the authors of these originals.
2.6 If we receive originals of inferior quality, we may refuse them, and any extra costs will be your responsibility.
2.7 All creative work we carry out is our property and cannot require delivery before, during or after completion of the service.
2.8 We may use designs we create (pre-press, print or post-press) for promotional purposes.
3. Production and Delivery Times
3.1 In printing there may be slight variations in color, generally within ±15%
3.2 To avoid problems with colors, we can provide a reference sample of three copies, showing the ideal color and expected variations.
3.3 Delivery times start on the business day following the award and depend on having all the necessary elements. Delays in the delivery of instructions or materials may affect deadlines and result in extra costs.
3.4 If we are unable to meet deadlines due to external events, this will not give rise to compensation.
4. Responsibilities and Claims
4.1 We accept written complaints within a maximum period of 3 working days after receipt of the product or service, provided that the product or service has not been altered. Complaints about quantities must be made at the time of delivery.
4.2 We are not responsible for normal variations in the graphics industry, such as differences in quantities, thickness, weight, size or colors.
4.3 You cannot, at any time, hold us responsible for direct or indirect damages arising from non-compliance with the above conditions.
4.4 If there is a discount or replacement of products or services due to dissatisfaction, this will be agreed after we receive all the items in the order and determine responsibilities.
4.5 We do not accept claims for damage caused by improper use, unfavorable environmental conditions, cases of force majeure or intervention by unauthorized third parties.
5. Packing and Transport
5.1 Our quotes do not include transport or special packaging, unless specified. The products are delivered to our facilities, and after that, they are under your responsibility.
6. Payments
6.1 Payments are normally divided into 3 phases. 30% when awarding the budget, followed by 30% when approving the final model and before starting production and 40% upon delivery.
6.2 If it is a project to be invoiced abroad, you will have to make full payment of the amount estimated in the budget after approval.
6.3 If you have late payments beyond the agreed deadline, you will only be able to place future orders after your account has been regularized.
6.4 Interest at the legal rate is applied 30 days after the invoice is due.
7. Jurisdiction and Applicable Law
7.1 We reserve the right to change these conditions, informing all customers by email.
7.2 These conditions are regulated by Portuguese law, and any dispute will be resolved in the courts of Vila Nova de Famalicão.
